Our client owned a mixed freehold investment on Croydon Road, Beckenham, comprising a tenanted retail premises on the ground floor and two long leasehold flats above. Following a probate valuation being completed by our colleagues in the valuation team and the grant of probate, the client’s objective was to sell the freehold investment and achieve the best possible price.
The sale presented several challenges. The retail tenant had occupied the premises for many years under a lease protected by the 1954 Landlord & Tenant Act, with two outstanding rent reviews and a passing rent significantly below market value. In addition, the long leasehold flats had only 77 years remaining, and one of the flats was owned by the retail tenant, accessible only through the retail premises. These factors made an open market sale difficult, and the optimal outcome required selling the property to the occupational tenant
Our Approach
To navigate these complexities, we adopted a dual strategy. The property was marketed openly to gauge market interest while simultaneously negotiating a potential sale with the existing tenant. This approach allowed us to maintain flexibility and ensure that the client could achieve a strategic sale aligned with their objectives.
The outcome was a successful sale to the occupational tenant at a price that would have been very challenging to achieve through an open market sale. Although the property was outside our usual geographical area and managing the tenant throughout the process presented occasional challenges, the desired result was achieved, delivering both financial and strategic benefits for the client.
This demonstrates the importance of combining market knowledge, proactive negotiation, and careful tenant management. By taking a structured and energetic approach, we were able to secure a result that maximised the value of the client’s investment, despite the complexities of the transaction.
